Article 13 of the Constitution of Kazakhstan:
  1. Everyone has the right to recognition of their legal personality and is entitled to protect their rights and freedoms by all means not contrary to the law, including necessary self-defense.
  2. Everyone has the right to judicial protection of their rights and freedoms.
  3. Everyone has the right to receive qualified legal assistance. In cases provided by law, legal assistance shall be rendered free of charge.

Legal Status of Foreigners in the Republic of Kazakhstan. Foreign nationals in Kazakhstan enjoy the same rights and bear the same obligations as citizens, except for those rights expressly reserved for citizens.
Foreigners cannot:
  • Vote or be elected.
  • Work in public service.
  • Serve in the military or in law-enforcement/security agencies.
  • Join or establish political parties.
  • Hold positions requiring Kazakhstani citizenship.
  • Access state secrets.
  • Own agricultural land (lease only).

Foreigners have the same rights as citizens in:
  • Civil and personal rights.
  • Labor and employment relations.
  • Business and entrepreneurial activities.
  • Property ownership (except agricultural land).
  • Judicial protection and access to legal assistance.
  • Freedom of movement and residence (within legal requirements).
  • Use of healthcare, education, and other public services on equal terms, unless otherwise required by law.
